  2. I think you're right, but we shouldn't even get that, given the precedent of Rangers taking the SFA to the court of session in 2012 and not even being cited for it, let alone punished.
  3. Well, quite. But if my reading is correct, we need to present that apparent inconsistency and failure to apply these rules when we answer the citation.

Don't see why a disciplinary charge for bringing the game into disrepute would be reserved for CoS; the other exception there seems more likely: 'with the exception of any matter for which the Judicial Panel or tribunals appointed therefrom have jurisdiction under these Articles'. Even then, an earlier article forbids disputes covered by the Judicial Panel protocol from being taken to a court of law. And 99.12 forbids an 'SFA Dispute' from being taken to a court of law.

  6. From my brief reading of article 99, it does seem to apply also to a dispute with the SFA, an 'SFA Dispute' as distinct from a 'Football Dispute'. Articles 99.6 and 99.9.
  7. Let me clarify; no mention that it should be arbitrated by the SFA procedure that we are being told has to be used.
  8. Had a brief look into it; the Court of Session overturned an SFA judgement on Rangers in 2012. No mention from anyone of the dispute having to go to arbitration; SFA argued it should go to the CAS.

  12. I should really go and read the articles, but I have a hard time believing the SFA and SPL would have granted us this binding arbitration without being told to by a judge, if we had just asked nicely. Even if it is the case, the court case was still worthwhile for me.

  15. Agreed; I have greatly appreciated his analysis and find it better-informed and more coherent than most others' (my own included). I don't agree with his conclusions on what the club should have done but welcome his thoughts.

Hearts and Thistle are *only* seeking to challenge their relegation, not the resolution as a whole.' That's what I thought too from our original statement. The stuff coming out today about letters sent to clubs contesting promotion seems to contradict this. I admit I'm confused on this.

Many of them had absolutely no compunction in condemning us to potential bankruptcy because 'there's nothing in it for us', as voters against reconstruction were quoted as saying. 'You only go to court when you have a clear legal case.' The published legal advice of our QCs was that we have a clear case of UK company law and the SPFL's own articles being broken.
  18. Re. 1. I don't believe we would have been relegated. 2. Don't give a shit about our standing in the game, I care about the survival of our club. Our standing in the game has been proved to be worthless, as despite it we are knifed in the back by our fellow clubs again and again. 3. No longer give a shit about the corrupt cesspool nest of vipers that is 'Scottish football'. If I could press a button that would bankrupt certain clubs and the league I would do it right now without a moment's hesitation.

  22. Out of likes, this is spot on. I have long stopped giving a shit if other clubs or the league go bankrupt, bring it on. Being nice guys has got us stabbed in the back repeatedly.
