  1. I can see this nonsense from 3BC ending up in court to determine the exact legal meaning of Colin Weir's will. Could it be that 3BC's tactic is to divide and rule by claiming that no one fan organisation represents all fans? In those circumstances, perhaps some sort of binding "Memorandum of Agreement" between The Jags Foundation, The Jags Trust and The PTFC Trust is needed to present a unified fan entity that would deny 3BC from doing that . Better still what about a legal amalgamation with only one fan group. (This is so obvious that I must have missed part of the saga.) I haven't been following this saga too closely, but has the Jags Foundation sought legal opinion on Weir's will?

  12. Not sure about Bannigan. He tends to slow play down, and is a bit like a latter day Paul McStay - runs round with the ball for a while then makes a 5 yard square pass he could have made at the start. Maybe he needs quicker and quicker witted men around him.

  14. The skill levels on display last night were not great - even allowing for the effects of the pitch. That suggests that luck and chance will play a big part on Friday. I don't think that tinkering with the team will achieve much given the alternatives. That said we need to score at least 2 goals and there must be a young striker we could use who would provide a risk free option. Players' commitment last night was fine and if repeated on Friday may give a surprise. The first goal is critical, and if we score it, would put much more pressure on Inverness than us. We still have a good chance of going through.
  15. The main issue with a third party owning the stadium is how to deal with maintenance and refurbishment costs. The stadium will need major expenditure in the next 5 or so years, and I think it would be better if the Club had full control over the costs of that and the timing. An unscrupulous stadium owner could extract an exhorbitent rent, and at worst could force the club into administration to recover debts. I suspect that the directors of the Raith Rovers Stadium Co. are the same as, or controlled by, the directors of Raith Rovers Football Club. A key issue in the debate on fan ownership is how to deal with large capital expenditure (stadium refurbishment). Owning the stadium gives the option of borrowing against it if that is deemed sensible. I am not a tax accountant nor a lawyer, and there may well be good financial reasons to separate ownership of the Club and the stadium, but the stadium surely would be best controlled by the Club. So I disagree with Woodstock Jag's assertion that stadium ownership is unimportant.

  17. Then PTD is right, TJF is the only vehicle for fan ownership. Even if fans were able to elect three (fan) Trustees, any casting vote would presumably lie with Britton, who would have no choice but to do Low's bidding. The Financial Conduct Authority specifies a Fit and Proper person test for those seeking financially responsible posts, as do various charity umbrella groups. I'm not sure whether the Foundation could approach say the FCA and ask for "accreditation" via a test of key elected members. That doesn't of course force Low's hand, but would strengthen the Foundation's claim to the shares.
  18. I agree that the TJF is the best home for the shares. The problem is that it appears that no-one other than Low can define what constitutes a "Fit and Proper" home for the shares. Unless there is a legal/financial definition, and the TJF can comply with and enforce that, she can then choose to place the shares with the PTFC Trust (apologies for not naming this properly in my earlier post) to allow her to retain effective control. Fans have to cover all eventualities, and should seek control of the PTFC Trust, probably by callling for an Extraordinary Annual General Meeting to set up elections for new trusty trustees.
  19. Low blunted the demands for fan representation on the PTFC Board by appointing her choices from the Jags Trust. With three Trust directors still on both boards, and no elections for the Trust board for years, the Trust seems to all intents and purposes controlled by Low. No matter how many fans sign up for the Foundation, Low will ignore that, and simply persuade the executors of the Weir estate that his wishes can be met by giving the shares to the Trust as a "fit and proper" organisation. We should be giving the Trust as much attention as the Foundation and pressing for elections ASAP.
  20. I hope that Low gets no ideas about a Firhill ground sale, pocket the proceeds, and move us to Cumbernauld.
  21. Some further questions. Who are the named beneficiaries of Colin Weir's will? Is Low one of them? My understanding is that if a shareholder or a group of shareholders acting in unison own at least 26% of the (PTFC) shares, then that individual/group can block any attempt to significantly change the nature of the business e.g. sell the ground and/or wind up the business.
  22. The Jags Foundation is now more important than before this latest Low debacle. We need a single organisation to represent all fans and become the recipient for any future transferred PTFC shares. That last requirement may mean a change to their constitution. For their part TJF need to modify their membership arrangements. They now need to ask for a single payment to become a member, thereby maximising the number of members,. I am not a lawyer, but I think TJF should take legal advice on whether Low is breaching the terms of Colin Weir's will, or indeed and any other of his written instructions.
